Although he proclaimed that the person of man is the noblest thing of earth—“La persona del home es la mas noble cosa del mundo”[1477]—he held that stripes and other torture inflicted judicially were no dishonor even to Spanish sensitiveness.[1478] Asserting that torture was frequently requisite for the discovery of hidden crimes,[1479] he found himself confronted by the Church, which taught, as we shall see hereafter, that confessions extorted under torture were invalid. Fox observed, that though this was a common objection, it appeared to him altogether an unfounded one; that on the contrary, the flowers often concealed the fruit beneath them, and the ornaments of style were rather an hindrance than an advantage to the sentiments they were meant to set off. Gained sometimes in a happy moment, it may persist for long years, successfully defying all assaults; achieved elsewhere by decades of strenuous application and scrupulous observance, it may vanish in a day as the result of some petty act of forgetfulness or of the stupidity of a passing moment. It may be said to be, at once, both what the logicians call, a singular, and what they call, a common term; and to join, in its signification the seemingly opposite qualities of the most precise individuality and the most extensive generalization. 1 for _Master_, read _Mastery_. The most fastidious could but be pleased with the beauty of the surrounding scenery—with the accommodation provided by enterprising individuals—with the civility and courteous demeanour of its inhabitants, who from the highest to the lowest grade, take every possible pains to deserve lasting esteem and friendship. A child’s feeling of the “fun of it” at the approach of the tickling hand seems to gain in volume and force with the repetition of the experience. No statement of this case; but it is said that, in the first instance, he was very violent. But we cannot do this in Statuary, because the disparity not being so great, the means do not appear so ingenious. The familiar fact that the readiness to laugh increases with practice, points to the same need of a certain comfortable assurance lying safely below the slight superficial apprehensions which are excited by the stimuli. It is surely unjust that a public-service institution should be at the mercy of such trivial chances. A notable illustration of this situation is the laughter heaped on the clergy by the people during the Middle Ages. The first question that arises in this inquiry is whether the smile or the laugh was the earlier to appear in the course of racial development. It will then (if this view can be established) be shown that the factors of conscience are: (1) emotional, (2) intellectual, (3) internal (including hereditary and organic elements), and (4) external (environment–material and auguste comte psychic); and that its validity, in ultimate analysis, can but rest on codes, which may be not only Conventional and Artificial, but also Rational or Intellectual, Social and Utilitarian; and in any case variable, in the same way that the soundest and most logical policies must, to a certain extent, be variable, or capable of adjustment as circumstances change; the only elements which should be constant and invariable in any policy (which is not a misnomer) being logic and truth. It will be seen from these remarks that the primitive speech of man was far more rudimentary than any language known to us. There is, however, a sort of profundity in sleep; and it may be usefully consulted as an oracle in this way. When Innocent heard of this he promptly had the bishop deprived of his see and a successor elected; his decision in this case was carried into the canon law as a precedent to be followed.[1340] In 1210, moreover, when Bishop Henry of Strassburg was vigorously persecuting heresy and convicting heretics by the ordeal, one of them named Reinhold hurried to Rome and returned with a letter from Innocent forbidding it for the future; ordeals might be adjudged, he said, by the secular tribunals, but they were not admissible in ecclesiastical judgments.[1341] Still more effective was his action when, under his impulsion, the Fourth Council of Lateran, in 1215, formally forbade the employment of any ecclesiastical ceremonies in such trials.[1342] As the moral influence of the ordeal depended entirely upon its religious associations, a strict observance of this canon must speedily have swept the whole system into oblivion. To begin with our laughter at novelties, the odd, the extravagant, what is it but the outcome of a play-impulse, a gay caprice which wills for the instant not to take objects seriously, but to disregard their real nature and significance, {151} practical, theoretical, and even ?sthetic, for the joy of making them playthings for the eye? What it is that constitutes the look of a gentleman is more easily felt than described. Smith and Pear[56] quote a striking but somewhat erratic case in which suggestion was conveyed purely by the faradic current. We are told further that, in the tenth month, Ruth would break into the same exultant laugh after some successful mental effort, such as pointing out the right picture when this was asked for. If you were to write a fable for little fishes, you would make them speak like great whales!’ The reproof was just. These distinctions were either grammatical or logical, that is, either formal or material. _Incorporation_, _Einverleibung_, is a structural process confined to verbals, by which the nominal or pronominal elements of the proposition are subordinated to the verbal elements, either in form or position; in the former case having no independent existence in the language in the form required by the verb, and in the latter case being included within the specific verbal signs of tense and mood. This condition will be satisfied if it is manifest that the upsetting of rule, so far as it is intentional, is not serious but a sort of make-believe; or that it is confined within the limits of the harmless, as in the case of the angry man vainly threatening denunciation against all and sundry; or, again, that the failure to comply with rule is not intentional but due to ignorance. It gives him little pleasure to look upon himself in the light in which other people actually look upon him, when he is conscious that, if they knew the truth, they would look upon him in a very different light. With regard to this there appears to have been a considerable diversity of practice among the races of primitive barbarians. This doctrine was even supported by the infallible authority of the papacy, as enunciated in 1203 by Innocent III. It is, I think, a plausible supposition that no sensation coming under the head of tickling is merely agreeable or disagreeable. I wish I could give you a formula for causing the flower of literary appreciation to unfold. But the characters and conduct of a Nero, or a Claudius, are what no custom will ever reconcile us to, what no fashion will ever render agreeable; but the one will always be the object of dread and hatred; the other of scorn and derision. 1. Whether the person who has received the benefit conceives gratitude or not, cannot, it is evident, in any degree alter our sentiments with regard to the merit of him who has bestowed it. In speaking of an object of laughter as having universal potency, we do not imply that it will, as a matter of fact, always excite the outburst. A child imagines that it gives a satisfactory answer when it tells you, that an object whose name it knows not is a thing, and fancies that it informs you of something, when it thus ascertains to which of the two most obvious and comprehensive classes of objects a particular impression ought to be referred; to the class of realities or solid substances which it calls _things_, or to that of appearances which it calls _nothings_. These were replaced, as we have seen in Egypt, by habitual resort to oracles, but that some recollection of the ancestral practices was handed down to later ages is shown by the allusions in the Antigone of Sophocles, when the guards protest to Creon their innocence as to the burial of Polynices, and offer to prove it by the ordeal:— “Ready with hands to bear the red-hot iron, To pass through fire, and by the gods to swear That we nor did the deed, nor do we know Who counselled it, or who performed it” (264-267). The philosophy is an ingredient, it is a part of Dante’s world just as it is a part of life; the allegory is the scaffold on which the poem is built. The structure of such a society is fairly illustrated by the incident which Gregory of Tours selects to prove the kingly qualities of Clovis. Mr. A true metaphysics, it is well to remember, is the very antithesis of mysticism, for it aims at the elimination of symbols; its method is to co-ordinate and synthesize, and by means of the systematization of materia to penetrate through and beyond, towards a realization of direction and of value; it tests the highest powers of the intellect. As soon as he learns to read we may begin to supplement it by reference to original documents. As when a small sum is unjustly taken from us, we do not so much prosecute the injury from a regard to the preservation of our whole fortune, as from a regard to that particular sum which we have lost; so when a single man is injured or destroyed, we demand the punishment of the wrong that has been done to him, not so much from a concern for the general interest of society, as from a concern for that very individual who has been injured.
